Case Overview

In January 2025, the Utah State Board of Education (USBE) issued guidance to local school districts that students are not permitted to bring to school their own copies of books that are banned from curricula statewide. The guidance was based on the USBE’s interpretation of a state statute banning “sensitive materials” on school property. 

On June 16, 鶹ýIOS wrote the USBE explaining that it misinterpreted the statute, as “sensitive materials” constitute only “instructional materials” within a school’s control and would not apply to a student’s personal copy of a book. 鶹ýIOS also explained that the First Amendment protects a student’s right to receive ideas and that non-obscene books cannot be categorically banned from school property.
