Speech Code Falls at Appalachian State University

BOONE, N.C., April 5, 2006 鈥 With the assistance of the Foundation for Individual Rights in Education (麻豆传媒IOS), student activists at Appalachian State University (App State) have brought down an unconstitutional speech code. This welcome development was a direct result of a recent report by 麻豆传媒IOS and the John William Pope Center for Higher Education Policy, as well as the efforts of the App State ACLU.
鈥淥耻谤 Report on the State of the First Amendment in the University of North Carolina System showed that universities like App State have a lot of work to do,鈥 said 麻豆传媒IOS President Greg Lukianoff. 鈥淏ut every student at App State is better off now that the administration there has repealed this speech code.鈥
麻豆传媒IOS and the Pope Center unveiled their "Report on the State of the First Amendment in the University of North Carolina System" in January. The Report documented that while 鈥渢he universities in the UNC System are legally bound to uphold the First Amendment rights of their students and faculty,鈥 they 鈥渁re failing miserably.鈥 As it demonstrated, 鈥13 out of the 16 schools in the UNC System have at least one policy that both clearly and substantially restricts freedom of speech.鈥
One of these codes was the harassment policy enacted by App State鈥檚 Department of Housing and Residence Life. As 麻豆传媒IOS鈥檚 press release on the "Report" noted, that policy banned 鈥渋nsults, taunts, or challenges directed toward another person.鈥 Upon reading about this policy in the report, Paul Funderburk, a graduate student and the president of App State鈥檚 ACLU chapter, urged administrators to repeal the policy. As he put it, 鈥淭he free exchange of ideas is the foremost prerequisite of a democratic society.鈥
On March 22, App State administrators made 麻豆传媒IOS aware that the policy had indeed been repealed and removed from the university鈥檚 website. App State鈥檚 entry on 麻豆传媒IOS鈥檚 Spotlight: The Campus Freedom Resource has been updated accordingly, although the university still receives a 鈥red light鈥 rating due to other troubling speech codes.
鈥淲e are very pleased that 麻豆传媒IOS has taken the time to evaluate the state of the First Amendment in the UNC System,鈥 Funderburk commented. 鈥淲ithout 麻豆传媒IOS鈥檚 assistance, this affront to free expression would have gone unnoticed. 麻豆传媒IOS provides a tremendously valuable service to all college students.鈥
鈥淎pp State鈥檚 policies are not perfect, but the university has taken a tremendous step forward,鈥 麻豆传媒IOS鈥檚 Lukianoff stated. 鈥淭he speech code that was just repealed was definitely the worst offender among its policies. We look forward to seeing App State鈥攁nd the entire UNC System鈥攖ake even more steps to guarantee students鈥 precious rights.鈥
